A1 Serrano, owner of the shop, said the horse was found “foil of holes and damn near destroyed." A n eyewitness, who refused to be identified, reported that at about 1:00 a.m. Friday he saw a group of people, including one person with a noose around his neck and wearing a cowboy hat, dragging the horse up the hill. He’d be the last person in the world to knock A8U*s athletic program and/or “the man they name mountains after. But he’s concerned, and justifiably so. that this whole issue might tarnish Kush and the A 8 U athletic dynasty. A t its monthly meeting Saturday in Tucson, the board rejected the claim on the recommendation of its legal counsel, thus opening the door for a civil suit. The beard's sctisa comes as no surprise, seeing as how it was named as a defendant along with head coach Frank Kush, assistant coach B ill Maskill and the U niversity. Now Rutledge and his attorney, Robert Hing, must file sint if the m atter is to be pursued. Rutledge's complaint charges that after a poor punt during A S U 's 41-7 loss to the U niversity of Washington last year, Kush “grabbed Rutledge's helmet and shook his head from side to side while yelling obscenities. “When the helmet came loose, M r. Kush then threw a punch under the face mask striking K evin in the mouth.” It also contends Kush called him a liar and repeatedly humiliated Rutledge in front of his team­ mates. Furtherm ore, it states, Kush and other coaches “conspired” to harass Rutledge off the team. Charles Adam s, the regent*’ legal counsel, refused Monday to discuss the legal grounds of the board's rejection, saying, in essence, that he didn't want to stick his neck out should the regents wind up defen­ ding a lawsuit. Apparently he’s get good cause to w orry, as both Rutledge and his attorney have indicated they plan to fight it out in court. Meanwhile, the state’s Risk Management Office is chef barfield investigating the claim, seeking evidence to either dispel or confirm Rutledge’s allegations. "Where it goes from here depends on a lot of d if­ ferent factors that we don't know yet,” said Ben Nygaard, assistant director of the office, wM clnacteas the state’s “insurance company.” M iller sees the potential suit as a threat to «»aches nationwide, a possible interference with their right to run the team the way they please. ' The state — i.e. A S U and the Board o f Regents — is alleged in the complaint to have failed “to supervise and control th eir servants and prevent them from i«g K evin into forsaking his contractual . . . relationships.” The statement contends Rutledge's scholarship constituted a legal contract with the U niversity which was broken when Rutledge was “forced” o ff the team. So far no one has been able to prove exactly what happened in Washington. I was m ore disappointed in our secondary, and eras extremely disappointed in our offensive line."
