Jurisdiction Question By Don Stevenson Aproblem of jurisdiction over ASU m ay have inadvertehtly . been a : factor in Tempo . Fire Department officials not knowing of thè existence of potentially dangerous chemicals before and during die ASU fire on Sept. 20. Since ASU buildings do not fan under the jurisdiction Of the city Of Tempe but under the state, ASU was hot required to file a list Of chemicals with the fire department. “We keep a file on ah buildings hi Tempe containing potentially dangerous chem icflls/’ «alii Battalion Chief Phil Van Dyke of tee Tempe Fire D epartm ent “But we weren’t aware of the chemicals being in that building,’’ (Van Dyke was die first'to discover there were chemicals in the burning building.) ASU Fire and Safety Inspector Sylvester An* (tersoli, said no list of the chemicals had been given to the fire deportment prior to foefiré. “I had not considered them chemicals as a fire hazard. But when they are involved in'a fire they become hazardous because of the toxicity of them,” he said; “We have tried to cooperate with them and keep them informed of what we b a ra over here, . such as radioactiye m aterials and fiammahte liquids. But we just hadn't gotten around to in forming the fire department of everything on campus yet," Anderson said. “I c a n t say they (ASU officials) don’t cooperate but we just d ont have die freedoms on campus to do some of die things we'd lite to do,” said Capt. Roninger of the Tempe Fire Depart-, m ent , y I Anderèon said tee city has no jurisdiction over tee state. “But we’re (ASU) under tee átate fire m arshal and if he tells us to —which be hasn't yet ,f w e 'l l do it.” -p | p f l p - v' ;p Anderson said that to the future every building containing diem icals will have a sign posted on the outside door.... Maricopa County Chief of Envfróbmental Sendees, Joseph Weinstein, who supervised the removal of waste m aterial after the fire, said tee waste material: Was not dumpéd to die river bottom. He said the waste was taken to the CountyCave Creek landfill by Physical Plato workers. “Hie wash w ater used on the fire had to drain somewhere and I guess that it wenttote the storm drains and ended iqi to the river,” said Weinstein. lie said the waste would have been extremely dUided to begin with. “We had a crew who went to the river bottom to take samples to be tested by our toboratories to see tf diera wfere any traces of the pesticides. From our standpoint there was no hazard.” ; V \ Weinstein m id the waste ttiatertai was derantamtoated before removal to the landfill, and a . pesticide expert was present when the m aterial was loaded onto tee three trades.
