A total of 1,395 bills were introduced, the fourth highest bill total in the last 52 years. A total of 387 bills were transmitted to the Governor for her signature. Of those 387 bills, 362 bills were signed and 25 were vetoed. The general effective date for legislation signed by the Governor is August 2, 2012 unless the bill specifies a specific date or contains an emergency enactment which is effective immediately. ACJC The Arizona Criminal Justice Commission (ACJC) continued to serve as a resource and forum for the discussion of these topics among diverse criminal justice interests. The ACJC actively tracked 225 bills, resolutions and memorials this session. This summary includes those pieces of legislation tracked by ourselves and our stakeholders. Executive Priorities Governor Brewer’s legislative priorities included personnel reform, restoring the Rainy Day Fund, restoring mental health funds, a balanced budget, and job creation. Other priorities included childwelfare reform. Three bills were introduced to implement a new manner of investigating all Child Protective Service cases where criminal conduct has been alleged. House Bill 2721 provides for the new Office of Child Welfare Investigations, a recommendation of the Governor’s Child Safety Task Force. House Bill 2794, also a product of the Governor’s Child Safety Task Force, improves communication between CPS and law enforcement; mandates annual reports detailing effectiveness of joint investigations; and streamlines CPS processes in an effort to improve efficiency and effectiveness. Finally, Senate Bill 1127 updates current Arizona statute to modify the factors a court must consider when determining what is in the best interest of a child. HB 2571 transitions of a majority of the State’s workforce to uncovered and at-will status. The bill also alters the management of the workforce, restructures the grievance and appeal process and updates human resources practices. Legislative Priorities The 50th Legislature had several legislative priorities. Included in them were tax cuts, job creation, regulatory reform, immigration, healthcare, public employees and redistricting. Of course a regular legislative priority is the state’s budget. A popular and frequent topic of consideration at the legislature are firearms and the privileges associated with carrying and purchasing them. A total of five bills were introduced in the Senate along that addressed preemption and possession of firearms on college and university campuses. 1      SB 1087 firearms; state preemption** SB 1304 firearms regulation; political subdivisions** SB 1448 misconduct involving weapons; public property* SB 1474 weapons; university; college grounds SB 1479 firearms; state regulation; preemption Of those five bills, three passed the Senate, two were heard in the House but none of them were transmitted to the Governor. * Passed Senate. ** Passed Senate and heard in the House. Budget Fiscal year 20013 state budget is $8.6 billion, up 3.5% from the fiscal year 2012 budget and included $700 million towards the Rainy Day Fund. State Aid to Indigent Defense Fund The State Aid to Indigent Defense Fund is authorized under ARS 11-588 and is made up of court surcharges outlined in ARS 41-2421. The Arizona Criminal Justice Commission administers the fund as directed by ARS 11-588. Last year the Indigent Defense Fund was “swept” (appropriated to another fund). This year the accrued deposits were not appropriated to any fund and the entire balance of the deposits will remain unused until appropriated in the upcoming legislative session. Criminal Justice Legislative Issues This year’s criminal justice issues ranged from increasing the penalties for metal theft (HB2396) to establishing stalking by electronic or digital means as a crime (HB2549). House Bill 2396/Chapter 53 redefines how the value of non-ferrous metal is calculated for the purposes of classifying the level of crime (ie: class 5 felony, class 1 misdemeanor, etc.) and for the purposes of sentencing. Statutes now mandate the repair or replacement value of the stolen metal versus the value of the metal to a scrap metal dealer. A high priority among criminal justice stakeholders was an effort to define the contents of “bath salts” as dangerous drugs to outlaw their sale. House Bill 2356 which passed as emergency measure to be enacted immediately enacted those definitions. Another important bill passed into law was Senate Bill 1147 which expanded the definition of sexually violent offense to include attempts to commit a sexually violent offense in another jurisdiction.
