In November of 1999, the Institute of Medicine (IOM) released a report: To Err is Human – Building a Safer Health System that stated as many as 40,000 – 90,000 preventable patient injuries occur within American hospitals annually. On July 20, 2006 the IOM released yet another sobering call to action when the newest study, Identifying and Preventing Medication Errors, found medication errors injure more than 1.5 million yearly. Perhaps the most stunning finding was that on average, a hospitalized patient is subject to a least one medication error per day. (www.iom.edu/cms/3809) Donald M. Berwick in an article in the New England Journal of Medicine in 2003; 348(25); 2,570-2 summarized efforts to improve patient safety in three ways: 1.) will; 2.) ideas and 3.) execution. His focus on execution of patient safety efforts alleges four major barriers: 1.) Most clinicians remain blind to care associated deaths, injuries and near misses, because of difficulties in recognizing, tracking and summarizing these events. 2.) Lack of appreciation of the true incidence and nature of the patient injuries leads to “unscientific theories” which result in counterproductive responses to the problem. 3.) Lack of a business case for safety, to justify and offset the larger investments that may be necessary to make care safe. 4.) Patient safety represents a difficult and complex problem. Arizona’s hospital health care teams of nurses, physicians, executives, pharmacists and others have demonstrated the will, ideas and execution to improve patient safety. On March 8, 2006, 30 hospitals from across the state gathered at the State Capitol for the Arizona Hospital & Healthcare Association’s Safe & Sound Patient Safety Awareness Day. Members of the legislature were informed of the many inventive programs that reduce medical errors and improve patient outcomes. Innovative programs that have been implemented to save lives and improve patient care delivery are: *Responding with Rapid Response Teams (RRT’s). Five hospitals have RRT’s comprised of critical care experts who are dispatched to the bedside when patients experience an unpredicted and rapid decline in condition. One of the goals of the RRT was to reduce the number of “code blue” calls outside of the ICU. One of the hospitals reported a 40% decrease in codes occurring outside of the ICU. *Preventing, identifying and reducing infections. Patients Safety Awareness Day featured initiatives that significantly reduced surgical site infections, increased the survival of septic patients and decreased blood infections associated with central venous catheters. This issue of the AzBN Regulatory Journal is the first in a series of columns that will focus on those who have prioritized patient safety as a critical imperative to reduce fatalities associated with health delivery systems. We all “hold the future of patient safety in our hands” through our will, ideas and execution. Practice Breakdown • For the last five years, I have had the privilege of serving as the chairperson of the National Council of State Boards of Nursing Practice Breakdown Advisory Panel. As some of you may know, the goal of this work has been to analyze nurse errors and learn new strategies to not only categorize errors, but also to assist boards, employers, and other regulatory boards in working to prevent errors. In addition, the panel was challenged by the IOM to “design uniform processes across states for better distinguishing human errors from willful negligence and intentional misconduct, along with guidelines for their applicability by state boards of nursing and other state regulatory bodies.” Members of the Practice Breakdown Advisory Panel include: Dr. Patricia Benner, Karla Bitz, North Dakota board of nursing; Lisa Emrich, Ohio board of nursing, Mary Beth Thomas, Texas board of nursing, Karen Bowen, Nebraska board of nursing, Kathy Schwed, New Jersey board of nursing, Dr. Kathy Scott, Banner Health, Dr. Marie Farrell and Vicki Sheets, NCSBN staff. The group designed and created the TERCAP (Taxonomy of Error Root Cause Analysis of Practice-Responsibility), an instrument to analyze nurse error that includes system, individual and practice responsibility areas. The tool is now ready for online collection of data from state boards of nursing. Data will be collected and analyzed for trends and profiles of nurse error. There are ten sections in the tool. Information will be collected specific to: 1. Patient Profile 2. Patient Outcome 3 Setting 4. System Issues 5.Health Care Team 6.Nurse Profile 7.Intentional Misconduct or Criminal Behavior 8.Practice Breakdown Within the practice breakdown, there are 8 categories of safe nursing practice that are analyzed with each case: 1. While today’s consumers may understand that administering medication takes more than a “spoonful of sugar,” they also do not fully appreciate its significance. According to the Journal of the American Medical Association, approximately half of all prescriptions are taken incorrectly and one of every 10 hospital admissions may be caused by incorrect medication consumption. “The public has a very nonchalant attitude about medications,” said Linda McCoy, PharmD, assistant director of Pharmacy Services at Yavapai Regional Medical Center in Prescott. “Nurses from all walks—clinics, home health agencies, hospitals, physician offices and elsewhere—have an incredible opportunity to educate patients about their medications and detect duplicate therapies.” To assist them, Arizona nurses and other caregivers have access to The Med Form. Patients keep The Med Form up-to-date by presenting it to their nurses, physicians and other providers at each healthcare visit. This gives caregivers an accurate medication history for the medical record and fosters communication between the caregiver and patient. “We want carrying The Med Form to be as automatic to consumers as carrying their health insurance card or their driver’s license,” said McCoy, who chairs the Arizona Hospital and Healthcare Association’s (AzHHA’s) The Med Form Work Group. Nurses at Phoenix-based Maricopa Integrated Health System (MIHS) are moving Arizona closer to this goal. According to Jordan Basco, RN, director of MIHS’s Medical-Surgical Services, nurses in the hospital’s Cardiac ICU and Surgical Unit have incorporated The Med Form into the discharge instructions they give patients. “We see The Med Form as a way to tie the loop between the medication reconciliation that occurs in the hospital and the medications patients take after leaving the hospital,” Basco explained. The MIHS nurses understand that The Med Form taps the patient’s role as a member of the healthcare team, doing so at discharge when nurses can provide crucial patient education. This is timely as 46 percent of all medication errors occur at transition points when patients are admitted, discharged and transferred between units or facilities, according to the Institute for Healthcare Improvement. The Med Form is sponsored by AzHHA’s Safe & Sound patient safety initiative, the Arizona Medical Association (ArMA) and the Arizona Partnership for Implementing Patient Safety (APIPS) as well as endorsed by more than 100 Arizona healthcare organizations. Denise is a Clinical Associate Professor at Arizona State University College of Nursing & Healthcare Innovation and is the Director of the ASU Health Center, a campus based academic nursing center that provides health care to ASU students and employees. The following cases illustrate the potential outcomes that await a nurse who exceeds his or her scope of practice: 1.) Nurse T. Z. is an LPN who obtained a verbal order for a narcotic pain medication to be administered as IV push for his assigned postoperative patient. The order was reviewed and signed by an RN. Later in the shift, the patient requested pain medication. T.Z. withdrew the IV medication and administered it. The next day the patient was cared for by an RN who noticed T.Z.’s initials in the medication record as administering an IV push narcotic. T.Z. admitted giving the medication because he did not want the patient to wait too long for pain relief. He felt he possessed the competency to administer the medication because he had watched nurses (RN’s) give IV pushes “hundreds of times – there’s nothing to it.” T.Z. did not have any other negative work history. The Board voted to offer a consent agreement for a Decree of Censure, permanent discipline on this LPN’s license. T.Z. had violated the Nurse Practice Act by “assuming patient care responsibilities for which the nurse lacked the education to perform or for which the nurse has failed to maintain nursing competence” (R4-10-403-9). Nurse T.Z. also failed to review the Board’s Advisory Opinion on Infusion Therapy/Venipuncture by an LPN that clearly defines LPNs ! NURSE X.P. WAS LATER ARRESTED FOR FORGERY, ADMINISTERING A NARCOTIC DRUG TO ANOTHER AND POSSIBLE HOMICIDE. cannot administer IV push medications other than saline and heparin flushes. 2.) Nurse A.O. is an RN who worked in a surgical area and had just scheduled a patient for a diagnostic procedure to be arizona STATE BOARD OF NURSING REGULATORY JOURNAL 13 given the next day. However, the physician forgot to include the usual pre-procedure orders that included medication and lab tests. It was late in the day and, feeling confident that she knew what the physician would have ordered, Nurse A.O. wrote orders for the medications and tests, signed the name of the physician, sent the orders to pharmacy, and entered the orders into the nurses’ task list for the next day. She then left the facility at the end of shift. Unknown to Nurse A.O., the physician cancelled the first test and scheduled a different test in its place that did not require any pre-procedure medication. Unfortunately, the medication orders written by the nurse were still on the unit’s nursing task list and in the patient’s medication record, and phar- macy had already sent the medication to the unit based on the order previously written by Nurse A.O. The next morning the assigned nurse gave the medication as written by Nurse A.O. and sent the patient for the procedure. Procedure area staff found the error, postponed the test, and management forwarded a complaint to AZBN. During the investigation, Board staff also identified a pattern of performance issues as documented by Nurse A.O.’s former employers. The Board voted to issue a consent agreement for 24-month probation with stipulations that included, among other terms, limitations in the Nurse A.O.’s practice settings and work hours, direct supervision by an RN, and completion of a course in nursing ethics. The Board cited the following Attention RN’s/LPN’s: IF YOU HAVE NOT YET RENEWED YOUR LAPSED 2006 LICENSE, PLEASE READ THE FOLLOWING BEFORE RENEWING YOUR LICENSE: A.R.S. § 32-1642 A. A professional and practical nurse licensee shall renew the license every four years on or before July 1. If a licensee does not renew the license on or before August 1, the licensee shall pay an additional fee for late renewal as prescribed in Section 32-1643. If a licensee does not renew the license on or before November 1, the license expires. It is a violation of this chapter for a person to practice nursing with an expired license. R4-19-305 C. A licensee who fails to submit a renewal application before expiration of a license shall not practice nursing until the Board issues a renewal license. Interpretation: To continue to practice nursing a nurse should renew his/her license before July 1 in the year in which their license expires. Nurses who renew their licenses before the July 1 (by June 30) deadline may continue to practice nursing while awaiting the issuance of a new license by the Board. Cancelled renewal checks, credit card statements or verification that your 14 application was received by the Board may be presented to an employer who requests proof that the license was renewed. If a nurse fails to renew before November 1 of the year the license expires, the nurse shall not practice nursing until the Board issues a renewal license. The last case involved Nurse X.P., an LPN, who administered at least 10mg of IV morphine sulfate IV push to a terminally ill patient and then signed the initials of an RN co-worker in the medical record as having administered the IV morphine. The patient died within 2 hours of having received the IV morphine. Nurse X.P. told others of what he had done, saying he was hastening the patient death. Witnesses to his statements reported the incident to the police department and also to AZBN. Nurse X.P. admitted working outside his scope of practice and falsifying a medical record, but denied contributing to the patient’s death. AZBN voted to summarily suspend Nurse X.P. license pending the outcome of the police and AZBN investigations. Nurse X.P. was subsequently arrested for forgery, administering a narcotic drug to another and possible homicide. Nurse X.P. pled guilty to and was convicted of forgery, a Class 4 Felony, and Unlawfully Administering a Narcotic Drug, a Class 6 undesignated count. Shortly thereafter, Nurse X.P. surrendered his nursing license. Under the felony bar statute A.R.S.§32-1637 (2), X.P. is not eligible for re-licensure consideration until at least five years have lapsed from the date he successfully completes all sentencing requirements related to the criminal conviction. Education Corner PAMELA RANDOLPH RN, MS EDUCATION CONSULTANT Excelsior College The Board has received numerous inquiries regarding Excelsior College in response to Dr. Malloch’s article in last quarter’s journal. Overwhelmingly the response was very positive when it was explained to callers that the Board had accepted Excelsior College’s proposal to offer a 120-hour precepted clinical experience. Many current enrollees stated that they would appreciate taking such a preceptorship to help them better pre- pare for their role as an RN. To summarize and update licensees on Board actions regarding Excelsior College, on January 25, 2006 the Arizona State Board of Nursing issued a Notice of Deficiency to Excelsior College for failing to meet the educational standards of the Board. The Excelsior College nursing program does not provide students with instructed clinical experiences as required by A.A.C. R4-19206. Excelsior College responded to the Notice of Deficiency with a plan to offer a 120-hour preceptorship to students enrolled or re-enrolled after September 1, 2006. On May 18, 2006 the Board approved Excelsior’s proposed preceptorship and approved Excelsior College to offer their Clinical Practice in Nursing Exam (CPNE) in Arizona upon implementation of the preceptorship program. Excelsior graduates enrolled after September 1, 2006 and endorsing into AZ must either complete the preceptorship or 960 hours of clinical practice as an RN in the state from which they endorsed. The Board did not make a formal decision on the status of currently enrolled students during the May meeting. At the July 19, 2006 meeting the status of Excelsior College students enrolled before September 1, 2006 was considered by the Board. The Board determined that currently enrolled students should be encouraged to take the preceptorship program before licensure, as the Board believes that instructed practice as a nursing student is an important component of nursing education. Applicants who enrolled before September 1, 2006 and have not taken the preceptorship will be licensed. NCLEX ® Confidentiality A question was recently posed to Tom O’Neill, Associate Director, NCLEX, asking if a faculty member can talk to a student about the content of the NCLEX exam after they have taken it. O’Neill responded by stating that if a student were to discuss the exam with a faculty member, they would be in violation of the “terms of confidentiality” agreed to 16 arizona STATE BOARD OF NURSING REGULATORY JOURNAL by the student before taking the exam. The terms include not disclosing the content of the exam before, during, or after the exam. Legal action including criminal prosecution, regulatory penalties, or civil litigation could be taken against a student who breaks the confidentiality agreement. If the inquiring educator makes a record of the exam information, they are also subject to legal action for violation of the National Council of State Boards of Nursing’s (NCSBN) property rights to the exam. O’Neill added that sometimes educators will unwittingly cross the line by asking students to discuss the exam and must understand that they are putting both the student and themselves at risk. Educators and students can access NCLEX information on the National Council of State Boards of Nursing (NCSBN) website www.ncsbn.org. Resources include test plans, frequently asked questions, the NCLEX tutorial, and the candidate bulletin. Another way for educators to obtain current NCLEX information is to attend the NCLEX Invitational which will be held on September 11, 2006 in Philadelphia, PA. Members representing the boards of nursing elected officers for a two-year term and two Directors-at-Large for one-year term. Kathy Malloch, PhD, MBA, RN, FAAN, board member, Arizona Board of Nursing, was elected as one of the Directors At Large. Malloch has served as Chair of the Practice Breakdown Advisory Panel and as a member of the Governance and Leadership Task Force. A board member of the Arizona Board of Nursing since 1999, Malloch is in her third term as president and is the current chair of the Education Committee and the past chair of the Scope of Practice Committee. 18 arizona STATE BOARD OF NURSING REGULATORY JOURNAL ADVANCED PRACTICE CORNER BY KAREN GRADY, MS, RN, FNP, BC ADVANCED PRACTICE CONSULTANT Advanced Practice Committee Highlights The Advanced Practice Committee is a voluntary advisory committee to the Board, whose members are appointed by the Board to serve a two-year term. The remaining 2006 AP Committee meeting is scheduled for October 20 at the Board office, located at 4747 N. 7th Street, Suite 200. At the January 13, 2006 meeting, the Committee discussed plans for the NP education day (NP Summit), related to NP scope of practice issues. The Summit is scheduled to take place on September 29, 2006, at Rio Salado College. A subcommittee was also established to address the issue of NP re-entry into practice. At the May 5, 2006 meeting, the Committee discussed the National Council of State Boards of Nursing (NCSBN) Vision Paper: The Future Regulation of Advanced Practice Nursing. The Committee made recommendations regarding the Vision Paper which the Board adopted at their May meeting and forwarded to NCSBN. The NCSBN has not finalized the Vision Paper and has agreed to work collaboratively with the American Nurses Association and the American Association of Colleges of Nursing to further develop the Vision Paper over the next 18 months. At the July 14, 2006 meeting, Committee members discussed subcommittee recommendations regarding proposed requirements for NP re-entry into practice, recommendations for a practice hour requirement, and the issue of educational requirements/competencies for expanding NP depth of practice. Proposed rules incorporating the recommendations were reviewed and suggestions for revisions were made. The revised rules will be brought back to the October 20 meeting. Committee members also reviewed and provided feedback on the proposed Prescription Monitoring Program for the Board of Pharmacy. Regulation by Pamela Randolph RN, MS RUNDOWN Rulemaking R4-19-215; R4-19-301; R4-19-302; R4-19-505; R4-19-506; and R4-19-507. These individual rules need revisions to address issues that have arisen since their adoption. A rulemaking docket was filed and published the Administrative Register on March 3rd, 2006. Amendments to Article 2 (R4-19215) will incorporate a process for rescinding the approval of an out-ofstate nursing program that does not substantially meet Board standards. Other amendments to Article 3 (R419-302) will give the Board discretion prescribe additional licensure requirements for an individual who graduates from a revoked nursing program. Amendments to Article 5 (R4-19-505) will extend the waiver of certification for clinical nurse specialists practicing in the area of maternal/infant health or women’s health since there is no certification exam. The other rules were opened to make technical and grammatical changes to improve clarity and internal consistency (R4-19-506; R4-19507). Articles 1 and 4 Extensive revisions of Articles 4 (Regulation) and 1 (Definitions and Time-frames) are underway. Zepeda was employed at a Phoenix hospital as an Anesthesia Technician in the Operating Room. He verified blood for a transfusion with a CRNA by signing his name and LPN on the blood bank slip. Zepeda does not hold an LPN license and there is no record at the Arizona State Board of Nursing that validates Zepeda completed an approved program of nursing study.
