2011 PUBLIC SCHOOL REPORT INDIVIDUAL INCOME TAX CREDIT FOR THE SUPPORT OF EXTRACURRICULAR ACTIVITIES OR CHARACTER EDUCATION PROGRAMS EXECUTIVE SUMMARY ● Public Schools reported receiving $48,443,537 in fees or cash contributions for the support of extracurricular activities or character education programs for 2011. This is an increase of 10.8% over the $43,718,717 reported for 2010. ● 250,210 donors contributed in 2011 compared to 250,004 in 2010. ● Donations averaged $194 for 2011 compared to an average of $175 for 2010 or a 10.9% increase. ● Public Schools reported spending $45,636,385 or 94.2% of the $48,443,537 received in 2011. In comparison, Public Schools reported spending $41,875,730 or 95.8% of the $43,718,717 received in 2010. ● Eleven School Districts reported receiving fees or cash contributions in excess of $1 million for a total of $25,402,283 or 52.4% of all contributions received. ● 408 School Districts reported receiving fees or cash contributions ranging from $5 up to $50,000 for a total of $4,066,874 or 8.4% of all contributions received. ● Maricopa County received $32,816,494 (or 67.7% of the $48.4 million) from 169,704 donors and spent $30,670,853 in 2011. Likewise, Maricopa County received $28,842,684 (an increase of $3,973,810 or 13.8%) from 156,435 donors and spent $27,869,477 in 2010. ● Pima County received $8,421,890 (or 17.4% of the $48.4 million) from 43,220 donors and spent $8,405,999 in 2011. Likewise, Pima County received $7,948,589 (an increase of $473,301 or 6.0%) from 40,221 donors and spent $7,048,076 in 2010. ● Elementary School Districts, Union High School Districts, Unified School Districts, and Accommodation School Districts reported receiving $42,031,601 from 225,779 donors and spending $38,115,409 in 2011. This is an increase of $3,837,238 (or 10.0%) over the $38,194,363 in fees or cash contributions received in 2010. ● Charter School Holders reported receiving $6,411,936 from 24,431 donors and spending $6,520,977 in 2011. This is an increase of $887,582 (or 16.1%) over the $5,524,354 in fees or cash contributions received in 2010. ● Fifty-two schools reported spending $848,764 on short-term capital items from 50% of the unencumbered contributions received prior to December 31, 2010 pursuant to Laws 2011, Chapter 195. Arizona Department of Revenue, Office of Economic Research & Analysis, May 2012 Page 1 2011 PUBLIC SCHOOL REPORT INDIVIDUAL INCOME TAX CREDIT FOR THE SUPPORT OF EXTRACURRICULAR ACTIVITIES OR CHARACTER EDUCATION PROGRAMS Arizona Revised Statute § 43-1089.01 provides a non-refundable individual tax credit for fees and cash contributions paid to public schools in Arizona for the support of extracurricular activities or character education programs. This credit is available only to individuals.1 The credit is equal to the amount of fees paid or amount contributed up to $200 for single or heads of household taxpayers and up to $400 for married taxpayers that file a joint return.2 Extracurricular activities are school sponsored activities that require enrolled students to pay a fee in order to participate. The activities must supplement the school’s education program. Extracurricular activities may include use of band uniforms, use of equipment or uniforms for varsity athletics, use of scientific laboratory equipment or materials, or in-state or out-of-state trips that are solely for competitive events. Extracurricular activities do not include any senior trips or events that are recreational, amusement or tourist activities. A character education program is a program defined in Arizona Revised Statute § 15-719. At a minimum, the character education program must include instruction in the definition and application of at least six of the following twelve character traits: truthfulness, responsibility, compassion, diligence, sincerity, trustworthiness, respect, attentiveness, obedience, orderliness, forgiveness and virtue. The school must provide instruction in grades kindergarten through 12. Contributions made or fees paid to a non-governmental school, a pre-school, a community college, a university, or a public school located outside of Arizona does not qualify for this credit. Public Schools must report on a calendar year basis to the Arizona Department of Revenue by February 28th of each year indicating the total number of donors, the total dollar amount of fees and contributions received and the amount spent by the school during the previous calendar year. New legislation (Laws 2011, Chapter 195) now requires the school to report the amount spent categorized by specific extracurricular activity or character education program. A report must be submitted even if the school received no fees or cash contributions. For calendar year 2011, Public Schools (which include Charter Schools) reported receiving $48,443,537 in fees or cash contributions from 250,210 donors for the support of extracurricular activities or character education programs. This represents a 10.8% increase over the $43,718,717 reported for 2010. The average fee or cash contribution per donor was $194 for 2011 compared to an average of $175 per donor for 2010. Public Schools reported spending $45,636,385 or 94.2% of the $48.4 million received in calendar year 2011. Additionally, some schools listed the type of expense rather than the extracurricular activity. Based on the information gathered, the Department of Revenue will continue to work with the Auditor General’s Office, the Attorney General’s Office, and the Arizona School Boards Association to assist schools in determining if an activity is tax credit eligible.
