PRIVATE SCHOOL TUITION ORGANIZATION INCOME TAX CREDITS IN ARIZONA: A SUMMARY OF ACTIVITY FY 2012 Arizona has four income tax credits for taxpayer donations to school tuition organizations (STOs). Two credits are for donations by individuals1 and two credits are for corporate donations.2 (The corporate donations can be claimed as a tax credit against corporate income tax or insurance premium tax.) The newest individual income tax credit was passed into law during the 2012 Arizona legislative session and, therefore, had minimal use during Fiscal Year 2012 (FY2012). It is described in more detail later in this report. CERTIFICATION Arizona law requires an STO to be certified by the Arizona Department of Revenue (ADOR) before it can begin collecting donations for tax credit purposes. The STO must be certified to collect donations from individuals and it must be certified to collect donations from corporations. Appendix I lists all STOs which collected donations during FY2012 and their certification period. A total of 57 STOs were certified to operate in FY2012. Thirteen STOs that were certified for individual donations did not have corporate certification. Four STOs that were certified for corporate donations did not have individual certification. One STO dissolved in November 2011; an STO with similar interests to the dissolved STO was certified in November 2011. TOTAL REVENUE STOs were required to report total revenues for FY12 in addition to total donations. Total revenues would include other income sources in addition to donations for purposes of the tax credit, like interest earned on donations, grants, employer matching funds when employees contribute, etc. STOs reported revenues of $201,169 in excess of tax-credit donations.3 Appendix II lists those STOs with revenues in excess of taxcredit donations. (Revenue and donations shown are from all credits.) Individual donations for the original credit have made up the majority of this amount, 87.4%, because of the longer period of time in which this credit has been available and because of a greater volume of donations. The second largest recipient of donations has been the Arizona Christian School Tuition Organization at $107.4 million or 18.5% of all donations (although this organization only accepts individual donations). Appendix III shows every organization that has received donations, with the total received by credit type, since 1998. The STOs that are highlighted are no longer operational. 4 Activity in 1998 was artificially low due to a court case challenging the constitutionality of the credit based on separation of church and state. Scholarships from individual donations have made up the majority of this amount, 90.8%, because of the longer period of time in which this revenue has been available and because of fewer restrictions on scholarships from individual donations than from corporate donations. The STO paying out the second largest amount in scholarships is the Arizona Christian School Tuition Organization at $98.5 million or 19.7% of all scholarships. Appendix IV shows every organization that has paid scholarships, with the total paid by credit type, since 1998. The STOs that are highlighted are no longer operational. SALARIES PAID STOs are required by statute to report the names, job titles and salaries of the three highest-paid employees. The 57 STOs certified in FY12 reported this information. Out of these 57 STOs, 37 (64.9%) were staffed by volunteers. Arizona Private Education 10 There have not yet been any scholarships from the new individual income tax credit donations, referred to as “Switcher” donations. 3 Scholarship Fund did not have any employees; however, they did contract with another organization to provide staff. Appendix V lists the 20 STOs that reported salaries. AUDIT OR REVIEW PROCESS STOs operating in Fiscal Year 2011 used 32 CPA firms, paying them $265,619.11 The audit or review cost is listed for each STO in Appendix VI. STOs paid as little as $500 and as much as $14,500 for their audit or review. These costs include audits or reviews for both individual and corporate receipts if the STO participated in both programs. INDIVIDUAL INCOME TAX CREDIT PROGRAM Arizona allows an individual income tax credit for donations made to STOs that provide scholarships to private schools. A taxpayer could receive an income tax credit for a donation of $500 (for single, unmarried head of household and married filing separate taxpayers) or $1,000 (for married filing joint taxpayers) in tax year 2011; those amounts increased to $503 and $1,006 in tax year 2012. Scholarships paid from these donations by STOs could go to any child attending a qualified private school. There were 49 STOs that received donations in FY2012. (Alternative School Scholarship Fund and Yo Creo may also have received donations but did not file an annual report. Two other STOs reported not receiving donations in FY2012.) A total of $52.1 million in revenue was reported in the fiscal year and $51.9 million in tax credit donations from 76,751 taxpayers. STOs can allow donors to make recommendations when donating (although Arizona law prohibits STOs from awarding scholarships solely on the basis of donor recommendations). In FY2012, twenty-seven of forty-seven STOs12 (57%) allowed donors to recommend specific students for scholarships when donating. Going a step further, for those STOs that allowed donor recommendations and for whom information was available, approximately 57% of their donations had recommendations. The following table shows the number of STOs collecting donations in each period, the number of donations and the amount of tax credit donations. Percent change is calculated for prior calendar year amounts reported. No percent change is calculated for FY2011 as this is the first fiscal year reporting period. 11 STOs pay for the audit or review in the year following the year for which the audit or review was done. Many families seek scholarships from multiple STOs, resulting in one child being counted several times in the scholarship counts. Two organizations, Arizona Native Scholastic and Enrichment Resource Foundation and Just Friends of Education, only gave scholarships to children in families with income of 185% or less of poverty level. Alternatively, Life Development Institute Education Foundation gave 97.1% of its scholarships to children of families with income greater than 342.25% of poverty level. Appendix VIII shows the percentages for each STO. The range of average scholarship amounts paid by STOs is from $386 (Just Friends of Education) to $7,048 (School Choice Arizona). Average scholarship ranges and the number of STOs with scholarships falling in each range is shown in the following frequency distribution. Avg. The most scholarship money received by one private school from all STOs was $1,436,657 for 872 scholarships to Northwest Christian School. Appendix X lists the 347 private schools that received scholarship money, the number of scholarships, the amount of scholarships and the average scholarship amount. The smallest average scholarship paid by an STO to a private school was $25 paid by the Arizona Private Education Scholarship Fund to Bethany Christian School in Tempe. Six private schools received average scholarships from STOs for more than $10,000. The highest average scholarship paid by an STO to one private school was $26,900 paid by School Choice Arizona to Neurologic Music Therapy Services. The following table presents the distribution of average scholarships. For example, the average scholarship received by four private schools (from all STOs) was between $1 and $250. From an administrative viewpoint, no STO is expected to pay out 90% of donations it receives in the current year in scholarships the same year. There will always be a lag between revenue received and revenue paid out. Having said that, many STOs are able to accomplish this 90% payout. That does not mean that an STO with a percentage of less than 90% is in violation of the law. ADOR is not currently concerned with the percentage of any STO. These percentages are being monitored annually, however, and if the STOs with low percentages do not improve, ADOR will review that program to determine the reason. Percentages for STOs certified to receive individual donations in FY2012 are shown below. The original individual income tax credit limits were $503 or $1006 in tax year 2012 (depending on filing status). Individuals could donate an additional $500 or $1000 (again, depending on filing status) in tax year 2012 and take this additional credit. This legislation became law after January 1, 2012, so there was limited participation in FY2012. Only 7 STOs reported “switcher” credit donations in FY2012, as shown below. CORPORATE INCOME TAX OR INSURANCE PREMIUM TAX CREDIT PROGRAM – SCHOLARSHIPS FOR LOW-INCOME STUDENTS The low-income student corporate income tax credit and insurance premium tax credit for contributions to school tuition organizations are governed by A.R.S. § 43-1183, A.R.S. § 20-224.06 and Chapter 15 in Title 43. (This section does not cover the corporate income tax/insurance premium tax credit for scholarships for disabled/displaced students, A.R.S. § 43-1184 and § 20-224.07.) There were 44 STOs certified to receive corporate donations during FY2012. Donations to STOs for the purpose of receiving the low-income student corporate income tax credit or insurance premium tax credit are limited by statute for each fiscal 11 year. For FY2007, the first year of the program, the limitation was $10 million. This limitation increases by 20% per year. In FY2012, the limitation was $24.8832 million. The following table shows the amount approved in each fiscal year as opposed to the amount received. The actual revenue of $19,149,998 can be compared to total donations for that period of $19,135,987, a difference of $14,011. There were 139 donations approved and received in FY2012 for the low-income student corporate/insurance premium credit and one donation approved in FY2011 but received in FY2012. Twenty-three STOs received the 140 donations ($19,135,987) from 84 corporations. (Thirteen of the 84 corporations are insurance companies.) Of the 84 corporations, 62 donated once; the remaining 22 donated from two to eight times. The following table shows the number and amount of donations received by each STO in FY2011. In terms of where the corporate scholarship money went within Arizona, the most money went to schools within Phoenix. About 36% of the scholarship money went to Phoenix private schools. As would be expected, 49% of the scholarship money went to schools in Maricopa County. Donations to STOs for the purpose of receiving the corporate income tax credit or the insurance premium tax credit are limited by statute for each fiscal year. The statutory limitation for donations made for the disabled/displaced tax credit is set at $5 million per fiscal year. The amounts are estimated for two reasons. For the first several years of the private school tuition organization tax credit program, there was no requirement for the STOs to report. Although some did report at ADOR request, some did not or only reported partially. . Therefore, the early year figures are incomplete. Secondly, the reporting period changed from calendar year to fiscal year, beginning with FY2011.
