Judy Lowe Commissioner COMMISSIONER’S CORNER As I travel around the state, meeting real estate industry professionals, I am hearing the good news that the Arizona real estate market is recovering. WHAT GREAT NEWS from those in the real estate industry who know the local real marketplaces. Active Inventory is shrinking; Prices are rising in most areas; Average days on the market is falling; Pending Sales are rising; Distressed Property numbers are declining. The Arizona Real Estate Market is turning the corner. In my travels, I am always asked, “What is making the phone ring at the ADRE?” Included here are a few of my answers: Property Management Issues – Fraudulent oversight and use of the Broker’s Trust Account, which is to be held “in trust” for property owners. Rental Schemes – Unauthorized Advertising of properties, many times with the collection of upfront fees, without the delivery of services, or the ability to execute an occupancy agreement. Sometimes, with the advertiser collecting the upfront fee, then disappearing. Rent to Own Schemes - Large deposits being collected, with the promise of the opportunity to buy the property at some date in the future, with monthly rents being collected and no mortgage payment being made by the collector of the monthly rents, and foreclosure follows. Unlicensed Real Estate Activity – By real estate licensees outside of their Designated Broker, as well as, real estate activity by unlicensed entities/individuals, such as, actions as an Unlicensed Assistant on a team, property management activities, short sale negotiations, representing buyers, as the bidder on the “steps of the courthouse”, representing buyers in the purchase of a property. Presentation of All Offers on a Property – Buyers who believe their offer was not presented; Sellers who believe all offers were not presented to them….Remember, all Rejected Offers must contain documentation that they were rejected by the Seller, then retained by the Brokers for one year from the time of rejection. Many issues that include violations of licensees in the areas of: Lack of Disclosureincluding material disclosures, as well as, the case of an undisclosed principal, ie the licensee, or relative, as one of the Buyers or Sellers. Also, the lack of submission of all addendums to a contract to all parties involved in the transaction, including the Buyer, Seller, Lenders, Brokers, Escrow; the lack of communication from the licensee to their client; Licensees signing documents for the Buyer and/or Seller. I know many of these actions are a surprise to the majority of our Arizona real estate professionals.
