Vehicle Issue 2 | Volume 6 | October 2015 SMOKE FREE ARIZONA NEWSLETTER The Smoke-Free Arizona Act, A.R.S. 36-601.01 (“the Act”), regulates smoking in vehicles when the vehicle is owned and operated by the employer during working hours when the vehicle is occupied by more than one person. In a taxi, for example, the driver can smoke inside the vehicle when the driver is alone. As soon as the taxi has a passenger, the driver is no longer allowed to smoke in the vehicle. The Act allows proprietors to implement a stricter in-house smoking policy prohibiting smoking inside company vehicles if they so choose. We encourage employees and the public to follow the smoking policy set by the company. A proprietor must firmly affix at least one sign to a vehicle door window, dashboard, or an area visible by each occupant.
