(The Commonwealth Fund. Survey of Women’s Health, May 1999) ⇒ In 2005, there were 389,100 women and 78,180 men victimized by an intimate partner. These crimes accounted for 9 percent of all violent crime. (Shannan M. In the case of an emergency, dial 911. 7 VIOLENCE COMES IN MANY FORMS Domestic violence is an epidemic; it affects all socioeconomic groups. It is the establishment of control and fear in a relationship through violence and other forms of abuse. Abusers use acts of violence and other behaviors, including intimidation, threats, psychological abuse and isolation, to coerce and control another person. The violence may not happen often, but it remains a hidden, terrorizing factor. Abuse can be verbal, emotional, financial, or sexual, but whatever the form of abuse, no one deserves it. Domestic violence disregards, disrespects and devalues a person, resulting in the eventual diminishing of the self-esteem. Consciously or unconsciously, victims often try to change their behavior, believing the abuse will stop if they change. Traits of an Abuser ‰ ‰ ‰ ‰ ‰ ‰ ‰ ‰ ‰ ‰ ‰ ‰ Ignores your feelings Ridicules or insults your most valued beliefs, religion, race, heritage, or class Continually criticizes you, calls you names, shouts at you, or humiliates you in public Keeps you from working, controls your money, makes all decisions Threatens to hurt you or your family Abuses, tortures or kills pets to hurt you Harasses you about affairs he or she imagines you are having Destroys furniture, punches holes in walls Handles weapons in a threatening way Monitors your whereabouts at all times Questions your parenting skills and criticizes you in front of the children Belittles your family and friends, and forbids you to see them In the case of an emergency, dial 911. 8 ARE YOU IN AN ABUSIVE RELATIONSHIP? Although there may be no physical evidence, such as bruises or bleeding, the scarring of verbal and emotional abuse often runs much deeper. After years and years of such battering, the scars of repeated verbal abuse kill the spirit and often adversely affect the body through guiltcaused diseases. Because verbal abuse is not as obvious as physical abuse, often victims can feel they are “crazy”, overly sensitive or exaggerating the situation. Verbal abuse may entail angry outbursts and name-calling, or more subtly demeaning remarks. Traits of a Verbal Abuser ‰ ‰ ‰ ‰ ‰ ‰ ‰ ‰ Blames you for the abuser’s outbursts or actions Does not accept your feelings and views Is silent and uncommunicative in private, or frequently demanding or argumentative Threatens to leave you, to commit suicide, or to report you to authorities Blames you in a sincere and concerned manner: “That’s why we have so much trouble in our communication”; “You really don’t understand the whole picture” Uses verbal tactics, such as withholding, countering, discounting, blocking or diverting, accusing or blaming, judging or criticizing, trivializing or undermining Uses mean comments disguised as jokes Calls you rude names Feelings are the foundation of our very being; they are the criteria by which we know if something is wrong or unsafe! In case of an emergency, dial 911. 10 PHYSICAL ABUSE Six times as many women victimized by their intimates, as opposed to strangers, failed to report violent victimizations because they feared retaliation from their batterer. Domestic violence is an attempt to control the behavior of another person. It is the misuse of power, which abuses the bonds of intimacy, trust, and dependency to make the victim powerless and unsafe. On average, it takes a woman seven interventions before she leaves the batterer for good. Because of the minimization and denial of violence, victims often do not report the abuse to police or others who can help. Battery is purposeful behavior aimed at acquiring power and control. Approximately 1/3 of the men counseled for batteries are professional men who are well respected in their jobs and their communities. These men include doctors, psychologists, lawyers, ministers and business executives. Although there is a high incident of drugs and alcohol present in violent relationships, it is not the cause; it is an excuse. Taking away the alcohol does not take away the abusive behavior. Traits of a Physical Abuser ‰ ‰ ‰ ‰ ‰ ‰ ‰ Frightens you with his/her temper Kicks, hits, shoves or throws objects at you Injures or threatens to injure the children, pets or special property Makes or carries out threats to do something to hurt you Makes you do illegal or unwanted things Makes you afraid by using looks, gestures or actions Displays weapons In case of an emergency, dial 911. 11 SEXUAL ABUSE Sexual abuse is any unwanted sexual contact. No matter who is involved, it is important to understand that sexual violence is not an act of sexual desire; it is an act of power and control. It should be noted that it was not until the 1970’s that marital rape was officially recognized as a crime in the United States. There is a continuum of sexual assault behaviors, which includes lewdness, peer or workplace sexual harassment, stalking, sexual conduct and sexual assault. Most frequently, sexual violence occurs when a man perpetrates violence against a woman, although it can and does occur by women to men, as well as between same sex partners. The U.S. Department of Justice estimates there were 272,350 sexual assaults in 2006 to individuals 12 years of age or older. According to RAINN, that means every two minutes, someone is sexually assaulted in America. Sexual abuse committed on a child includes unwanted touching or penetration in any body opening with any object. It includes unwanted fondling, relating to a child as a potential sexual partner, and forcing the child to be physically affectionate to another adult or peer. It can also involve forcing the child to be physically affectionate to another peer. Child sexual abuse is not solely restricted to physical contact; such abuse could include noncontact abuse, such as exposure, voyeurism, and child pornography. Often abusers threaten harm to the child victim if she or he discloses the abuse. Traits of a Sexual Abuser ‰ ‰ ‰ ‰ ‰ ‰ Accuses you of being unfaithful Forces you to do sexual things you do not want to do Uses jealously to justify his actions Uses sex as an act of aggression to enhance self esteem Says victim asked for it, caused it or encouraged abuse Commits any sexual act with a child In case of an emergency, dial 911. 12 CHILDREN IN VIOLENT HOMES Children are often the indirect victims of battering. Children in violent homes face the threat of witnessing traumatic events and the threat of direct abuse. Children in violent homes are also at a high risk of neglect. The effects on children range from physical and emotional impairments to behavioral problems. A national survey found that 50% of men who frequently assaulted their wives also frequently abused their children. More than half of the women who experience intimate violence live in households with children under the age of 12. Children who witness domestic violence are more likely to exhibit physical and behavior problems and are more likely to attempt suicide, abuse drugs and alcohol, run away, engage in prostitution and commit sexual crimes. A study in Ohio found that children and teenagers’ violent behavior can be predicted by recent exposure to violence in the home (Family Violence Prevention Fund. Children and Domestic Violence. 2007. http://www.endabuse.org/programs/display.php3?DocID=77). Traits of a Child from a Violent Home ‰ ‰ ‰ ‰ ‰ ‰ ‰ ‰ ‰ Traumatized by fear for the victim Blames self for not preventing the violence Has psychosomatic disorders, such as stuttering, anxiety, sleep disruption and school problems Identifies with aggressor and loses respect for the victim Has serious problems with temper tantrums, including continual fighting at school or between siblings Treats pets cruelly or abusively Attempts to get attention through hitting, kicking or choking Takes on adult roles prematurely Learns extreme behaviors In case of an emergency, dial 911. 13 ELDER ABUSE Reported elder abuse and vulnerable adult abuse and neglect increased by nearly 20% between 2000 and 2004 (National Center on Elder Abuse, Survey of Adult Protective Services, 2004). Elder abuse includes assault, neglect or exploitation of an incapacitated or vulnerable adult. The elder may be the victim of direct beatings, sexual assault, unreasonable physical restraint, prolonged deprivation of food or water, or placed in a situation where his/her health or welfare is endangered. The elder may express a hesitation to talk openly, may present implausible stories as excuses for bruises or other wounds or may be unable to speak at all. Elder abuse often occurs in nursing homes or the victim’s home. Many times the elder feels shame or guilt and does not report the abuse because the abuser is the adult child of the victim. Sometimes the abuse is not reported because the victim suffers from a disease, such as Alzheimer’s, that prevents her or him from soliciting help. Traits of an Elder Abuser ‰ ‰ ‰ ‰ ‰ ‰ ‰ ‰ Uses powers of attorney illegally Threatens physical violence Commits telemarketing fraud Steals or misuses an elder’s money or property Fails to assist in personal hygiene or the provision of clothing for an elder Fails to provide care for physical and mental health needs Fails to protect an elder from health and safety hazards Abuses verbally, instills fear, humiliates, intimidates or isolates an elder In case of an emergency, dial 911. 14 WHAT TO DO IF YOU ARE A VICTIM ⇒ Find someone trustworthy who is willing to help ⇒ If you have been assaulted or abused in any way, report the incident to your local police immediately and keep a copy of every report made ⇒ If you have been injured, seek immediate emergency medical care and take photographs of any injuries ⇒ Make a safety plan (see page 16) ⇒ If your safety is in jeopardy seek safe, temporary housing through friends, family or an emergency shelter or Safe Home ⇒ Seek an Order of Protection or an Injunction Against Harassment ⇒ Save all documentation possible (such as a written journal, social security cards, birth certificates, school records, all legal documentation of the abuse, divorce papers, police reports, etc.) If you or someone you know needs help with a domestic violence or sexual assault situation, please refer to the resources in this book. These valuable resources can assist with housing, economic, childcare, counseling and legal issues. Battered Immigrant Women Federal law specifically addresses the rights of battered immigrant women. If you are an immigrant in a domestic violence or sexual assault situation, please refer to the Immigrant Services resources listed in your county. You may also call 1-800-799-SAFE. In case of an emergency, dial 911. 15 MAKE A SAFETY PLAN 1) Plan to leave, even if at the time you do not think it will be necessary. That way if you need to leave, you will be ready. Have duplicate car keys, bus tokens or cab fare hidden outside in a safe place that can be immediately accessed. Important papers should also be available, such as passports, birth certificates, bankbooks, school records, immunization records, medical insurance cards, Social Security cards, Orders of Protection or Injunctions Against Harassment and any other legal documentation of abuse. 2) If an argument is inevitable, attempt to move to a room where there are no weapons available (kitchen knives, guns, tools) and where there is more than one exit from the room. 3) Teach young children how and when to use 911. Identify a code word that your children will recognize as a signal to call the police. 4) Discuss a safety plan with your children and identify which neighbors they should go to for assistance. 5) An Order of Protection or Injunction Against Harassment can be obtained. If you obtain an Order or Injunction, keep a copy and proof that it has been served with you at all times. Be sure your child's day care center or school has a copy and knows to show it to the police if a crisis should arise. 6) Prepare a safety plan for when you are at work or on your way to or from work. You should vary your route and, if you can, never travel alone. Alert your employers of potential problems so they can assist you. In case of an emergency, dial 911. 16 LEGAL RESOURCES There are legal steps that may help to deter violence and abuse. Orders of Protection and Injunctions Against Harassment Victims may obtain an Order of Protection or an Injunction Against Harassment from their local civil court. Applications may be available at courthouses, police stations, shelters or legal service offices. An Order of Protection or an Injunction Against Harassment instructs that the abuser must stay away from the victim. The Order of Protection or Injunction Against Harassment is valid for one year after served to the abuser. After one year, it must be renewed in the court. If the abuser violates the Order or Injunction, notify the police and show a copy of the Order or Injunction. Copies should be given to schools, day care centers and trusted family and friends. As of August 9, 2001 there is no filing fee. Call the appropriate court numbers listed in your county for more specific information. Full Faith and Credit Properly obtained and served Orders of Protection are valid not only in the jurisdiction of the issuing court, but throughout the United States. To file either legal action, you must provide the court with: ⇒ The name of the defendant, date of birth, etc. ⇒ A list of the acts of violence or harassment ⇒ Your address and phone number (this information is confidential and will not be revealed to your abuser) ⇒ An address where the defendant can be served and a physical description of the defendant TO LEARN MORE ABOUT THE LEGAL SERVICES AVAILABLE, REFER TO YOUR COUNTY’S LEGAL RESOURCES SECTION IN THIS BOOKLET. This call center operates 24 hours a day, 7 days a week. Participation in the project includes approximately 60 agencies, 35 of which are on-line with CONTACS. Spanish speaking operators and TTY capabilities are also available. The City of Phoenix Human Services Department coordinates and oversees CONTACS.
