August 2012 Volume 3, Issue 2 Smoke-Free Arizona Newsletter FOR BUSINESS PROPRIETORS AND PROPERTY MANAGEMENT COMPANIES The Smoke-Free Arizona Act, A.R.S. 36-601.01 (“the Act” or “the Law”), prohibits smoking inside and within 20 feet of entrances, open windows, and ventilation systems of most enclosed public places and places of employment. Some examples of public places and places of employment that have to comply with the Law include office buildings, strip malls, high-rise buildings, and commercial and retail properties. In certain facilities, properties, or establishments, some requirements of the Act fall under the property management’s responsibility. For example, if a property management company provides ashtrays throughout outdoor areas of a high-rise building, the property management company is responsible for the placement of the ashtrays provided. In a high-rise building, the property management company is also responsible for posting signs at all entrances into the building, since entrances are shared by all tenants. When entrances are not shared by all tenants, each tenant is responsible for posting signs at their own entrances. Tenants may also be responsible for ashtrays provided by their specific business for their patrons. Please remember that business owners, proprietors, and managers are responsible for areas under their control. The Smoke-Free Arizona Act requires proprietors to inform violators if they are smoking in a non-smoking area by politely asking that they put out their lit tobacco product or that they go outside and at least 20 feet away from entrances to smoke. In some establishments, this responsibility falls under the property management company. The most effective way to educate visitors, clients, and patrons is to post the required “No Smoking” sign at every entrance into the establishment, thus alerting everyone that smoking inside and within 20 feet of entrances is prohibited. Please keep in mind that proprietors are also permitted to make custom “No Smoking” signs, as long as they meet the requirements of the Act. SMOKE-FREE PROPERTIES The Smoke-Free Arizona Act allows proprietors to designate any area under their control as smoke-free. For proprietors who choose to designate their property as a smoke-free campus, please keep in mind that Smoke-Free Arizona officials can only enforce the provisions as defined in the Act.
